Welcome to patternfaculty.com also hereby known as “we”, “us” or “Pattern Faculty”. We are an online marketplace focusing on digital pattern construction and dressmaking classes.  These are the terms and conditions governing your access and use of Pattern Faculty along with its related sub-domains, sites, mobile app, services, social media platforms and tools (the “Site”).  The services offered by Pattern Faculty under this Terms and Conditions include various products and services of Pattern Faculty and also a variety of products from different vendors worldwide for our customers.

Pattern Faculty may, in its sole discretion, reserve the right to make changes, modify, add or remove Pattern Faculty website, its terms and conditions, Privacy Policy, Condition of Sale and any other publicly displayed conditions or service promise at any time, with or without notice. Such changes or modifications shall be made effective for all Subscribers upon posting of the modified Agreement here. You are responsible to read this document from time to time to ensure that your use of the Service remains in compliance with this Agreement. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

AGREEMENT

By using patternfaculty.com, you hereby accept and agree to comply with these terms and conditions (the “User Agreement”) including our Privacy Policy and the Condition of Sale. This User Agreement is deemed effective upon your use of the Site which signifies your acceptance of these terms. We highly recommend you to read this agreement thoroughly before using this site. If you do not agree to be bound by this “User Agreement” please do not access, register with us or use this Site and any of our related sub-domains, sites, mobile apps, services, social media platforms and any other tools provided by Pattern Faculty.

LICENSE AND ACCESS

We grant you a non-transferable, revocable and non-exclusive license to use the Site, to shop and purchase product and services for personal use from the listed product and services on the site. Commercial use or use on behalf of any third party is prohibited, except as explicitly permitted by us in advance. If you are registering as a business entity, you represent that you have the authority to bind that entity to this User Agreement and that you and the business entity will comply with all applicable laws relating to online shopping. No person or business entity may register as a member of the Site more than once. Any breach of these Terms and Conditions shall result in the immediate withdrawal of the license granted in this paragraph without notice to you.

TERMINATION OF YOUR AGREEMENT

We may terminate or suspend your account (any related accounts) and your access to the Services at any time, for any reason, and without advance notice. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our site for product purchase or use any of our Services. Pattern Faculty may refuse service to anyone, at any time, for any reason.

You may terminate your account with Pattern Faculty at any time. If you wish to do so, please send us an email so that we can take the necessary actions to comply with your request.  However, terminating your account will not affect the availability of some of your content or pictures that you posted through the Services prior to termination. If applicable, all your outstanding payments must be paid before to terminating your account.

You agree and undertake not to perform restricted activities listed below which will result in immediate cancellation of your account, services, reviews, orders or any existing incomplete transaction with us and in severe cases may also result in legal action.

  • Use the patternfaculty.com for illegal purposes.
  • Post, promote or transmit through the Site any prohibited materials as deemed illegal.
  • Attempt to gain unauthorized access to or otherwise interfere or disrupt other computer systems or networks connected to the Platform or Services.
  • Impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity.
  • Use or upload, in any way, any software or material that contains, or which you have reason to suspect that contains, viruses, damaging components, malicious code or harmful components which may impair or corrupt the Site’s data or damage or interfere with the operation of another Customer’s computer or mobile device or the Site and use the Site other than in conformance with the acceptable use policies of any connected computer networks, any applicable Internet standards and any other applicable laws.
  • Refusal to comply with the Terms and Conditions described herein or any other guidelines and policies related to the use of the Site as available on the Site at all times.

AGE RESTRICTION

To use the Pattern Faculty Service and access any of our web sites, you need to;

  1. be 18 years of age or older;
  2. be 13 years or older and have your parent or guardian’s consent to the Agreements;
  3. have the power to enter a binding contract with us and not be barred from doing so under any applicable laws;
  4. be resident in a country where the Service is available;

It is the responsibility of the account holder to make sure anyone using your computer or any other device to access patternfaculty.com is within the legally allowed age limit as per the laws of the country you are visiting from. You are responsible for all account activity conducted by a minor on your account.

TRADEMARKS AND COPYRIGHT

All content included in or made available through patternfaculty.com such as texts, graphics, images, logos, page headers, button icons, scripts, audio and video clips, drafted patterns, downloads, data compilations, software, and service names are registered or unregistered trademarks or trade names of Pattern Faculty its affiliates, its Partners or its content suppliers properties and many are protected by international copyright laws. Unless otherwise stated, the copyright and any other rights in all material on this site are owned by patternfaculty.com.  Use of documents and related graphics on this site is for information and/or personal use only.  Any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purpose or to print extracts for personal use.  No documents or related graphics on this site are to be modified in anyway.  Images on this site are not to be used separately from the accompanying text.

No part of this website may be reproduced or stored in any other website or included in any public electronic retrieval system, electrostatic or mechanical, including photocopying, recording, magnetic tape, text, images, videos, audio or by any informational storage or retrieval system or otherwise without prior permission in writing dated and signed by patternfaculty.com.  No use or display may be made of the names or logos of patternfaculty.com without prior written permission.

ACCOUNT – PAYMENTS (CREDIT CARDS)

We accept all online activated VISA, MasterCard & American Express debit/credit cards. If you have any questions, you must contact us before processing your payment.

You need your own Pattern Faculty account to use certain paid Pattern Faculty Services, and you will be required to be logged in to your account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we will charge any other valid payment method associated with your account. You are responsible for maintaining the confidentiality of your account and password and for restricting others accessing your account.   You agree to accept responsibility for all activities that occur under your account. Pattern Faculty may sell products and services (classes) for children, but it sells them to adults who can purchase with a credit card or other permitted payment method. If you are under the age of majority in your province of residence or country, you may use the Pattern Faculty Services only with involvement of a parent or guardian. Pattern Faculty reserves the right to refuse service, terminate your account, terminate your rights to use Pattern Faculty Services, remove or edit content, or cancel orders in its sole discretion.

IDENTITY AND INFORMATION ACCURACY

You agree that any registration information that you submit to Pattern Faculty is true, accurate, and complete, and maintain it as long as your Pattern Faculty account is active. You agree not to use false information or impersonate another person or company through your account. You also agree not to use language that is offensive, vulgar, or infringes someone’s intellectual Reviews, Comments, Communications, and Other Content

Visitors may post reviews, comments, photos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Pattern Faculty reserves the right (but not the obligation) to remove or edit such content but does not regularly review posted content.

CONTINUED AVAILABILITY OF THE SITE

We will do our utmost to ensure that access to the Site is consistently available and is uninterrupted and error-free. However, due to the nature of the Internet and the nature of the Site, this cannot be guaranteed. Additionally, your access to the Site may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.

YOUR CONTENT AND PERMISION

Anything that you submit to the Site and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, “Submissions”) will become our sole and exclusive property. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third-parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions without any notice or legal course applicable to us in this regard.

If you do post content or submit material, and unless we indicate otherwise, you grant Pattern Faculty a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, produce, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, communicate to the public by telecommunications and display such content anywhere in any media for all purposes, including advertising and promotions. You grant Pattern Faculty and sub-licensees the right to use the name that you submit in connection with such content if we choose. You represent and warrant that you own or otherwise control all the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Pattern Faculty for all claims resulting from content you supply. Pattern Faculty has the right but not the obligation to monitor and edit or remove any activity or content. Pattern Faculty takes no responsibility and assumes no liability for any content posted by you or any third-party.

ELECTRONIC COMMUNICATIONS

When you use any Pattern Faculty Service or send e-mails, text messages, and other communications from any device to us, you are communicating with us electronically. When you become a buyer or a seller at Pattern Faculty by signing up, you have given us the consent to receive communications from us electronically. We will communicate with you electronically in a variety of ways, such as by e-mail, text, in-app push notices, or by posting notices and messages on the Pattern Faculty site or through other Pattern Faculty Services. You agree that all agreements, notices, messages, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

PRODUCT DESCRIPTIONS AND PRICING

Pattern Faculty attempts to be as accurate as possible. However, Pattern Faculty does not warrant that product descriptions or other content of any Pattern Faculty Service is accurate, complete, reliable, current, or error-free. If a product offered by Pattern Faculty itself is not as described, your sole remedy is to return it in unused condition. However, all digital and downloadable products cannot be returned and once it is sold it is considered as a FINAL SALE by Pattern Faculty.  There is no return policy for any digital and downloadable product(s).

“List Price” means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We regularly check List Prices against prices recently found on the Pattern Faculty site and other retailers. Certain products may have a “Was Price” displayed, which is determined using recent price history of the product on the Pattern Faculty site.

Concerning items sold by Pattern Faculty, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalogue may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.

RISK OF LOSS, RETURNS AND REFUNDS

  •  All our patterns are in Digital Downloadable – PDF format. There is no return policy for any digital and downloadable product(s).  All digital and downloadable products are considered as a FINAL SALE and cannot be returned or cancelled.
  •  If for any reason, you may need to cancel your order, you may do so before the item is processed by logging into your account – order section at Pattern Faculty website.  This rule does not apply to any free shipments due to tracking unavailability.
  •  If you need to request a return, you must contact us immediately upon delivery.
  •  If there is any discrepancy of the product(s), you must contact Pattern Faculty immediately in writing.
  •  Pattern Faculty does not refund any products until the item(s) is returned and received by the seller within a reasonable time. At our discretion, a refund may be issued without requiring a return.
  •  It is customer’s responsibility to bear the return shipping charges. This may vary from case to case.
  •  Refunds are processed back to the original payment method used to purchase the order. Typically, you can expect your payment provider to credit you for your refund within 14 business days. If you are having trouble locating your refund, we recommend contacting your payment provider for further assistance

GIFT CARDS AND PROMOTIONS

Gift Cards expire at midnight on the expiration date mentioned on the card and are provided for products and services only.  If any shipping costs attached to the item(s) purchase using the Gift Card, it must be paid separately. Promotions are limited time offers and valid based on the terms of the offer.

OTHER BUSINESSES

We may allow and provide links from other businesses on our website for our customer’s convenience.  If you purchase any of the products or services offered by these businesses or individuals, you are purchasing directly from those third parties, not from Pattern Faculty. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their web sites. Pattern Faculty does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use before purchasing any product or services from them.

LIABILITY

To the fullest extent permitted by law, neither Pattern Faculty, nor our employees,  partners, shall be liable to you for any lost profits or revenues, or any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the Services or these Terms.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The laws of certain jurisdictions, consumer protection act, do not allow limitations on implied warranties or conditions or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the below disclaimers, exclusions, or limitations might not apply to you, and you might have additional rights.

The Pattern Faculty services and all information, content, materials, products (including software) and other services included on or otherwise made available to you through the Pattern Faculty services are provided by Pattern Faculty on an “as is” and “as available” basis, unless otherwise specified in writing. Pattern Faculty makes no representations or warranties of any kind, express or implied, as to the operation of the Pattern Faculty services or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the Pattern Faculty services, unless otherwise specified in writing. You expressly agree that your use of the Pattern Faculty services is at your sole risk.

To the full extent permissible by applicable law, Pattern Faculty disclaims all warranties and conditions, express or implied, including, but not limited to, implied warranties of title, merchantable quality and fitness for a particular purpose. Pattern Faculty does not warrant that the Pattern Faculty services, information, content, materials, products (including software) or other services included on or otherwise made available to you through the Pattern Faculty services; its servers, electronic communications, or e-mail sent from Pattern Faculty services are free of viruses or other harmful components. Pattern Faculty will not be liable for any damages of any kind arising from the use of any Pattern Faculty service or any information, content, materials, products (including software) or services included on or otherwise made available to you through any Pattern Faculty service, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

EVENTS BEYOND OUR CONTROL

Pattern Faculty will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

OUR SITE SOFTWARE

You agree that our Software including regular updates or upgrades to the Software and any related documentation that we make available to you from time to time for your use in connection with the Site (the “Software”). You may use the software solely for purposes of enabling you to use and enjoy our services as permitted by the Terms and Conditions and any related applicable terms as available on the Site. You may not incorporate any portion of the Software into your programs or compile any portion of it in combination with your programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the Software or otherwise assign any rights to the Software in whole or in part. You may not use the Software for any illegal purpose. Your rights to use the Software will automatically terminate without notice if you fail to comply with any of the Terms and Conditions listed here or across the Site.

All software used in any of our services are our property and some may belong to our affiliates or its software suppliers. All Software used is protected by international copyright laws.   You will not and encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with our software whether in whole or in part or create any derivative works from or of the Software. To keep the Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.

We reserve the right to modify this Terms and Conditions at any time, so please review this page frequently. Pattern Faculty may, in its sole discretion, change or modify this Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Subscribers (customers, vendors, sellers and visitors) upon posting of the modified Agreement HERE.  You are responsible to read this document regularly to ensure that your use of the Service remains in compliance with this Agreement. If you continue to use our services or websites following an amendment to this Agreement, you will be deemed to have consented to the updated Terms and Conditions of Pattern Faculty. If our store is acquired or merged with another company, your information may be transferred to the new owners so that they (we) may continue to sell products to you.
